Terms of Agreement
Introduction
These Terms of Agreement ("Terms") govern your use of the Network In Action International ("NIA") mobile application ("App"). By downloading, accessing, or using the App, you agree to these Terms.
Role of NIA
NIA facilitates introductions between consumers and independent service providers who are part of its professional network. NIA does not provide any services directly and does not employ or contract any of the listed providers.
Background Checks Disclaimer
While NIA may require background checks on one representative of a member business, this does not guarantee that the individual performing work at your location has been personally screened. NIA disclaims all liability for any acts or omissions by service providers or their personnel.
Payment Terms
NIA does not handle or process payments between users and service providers. All payments for services rendered are the sole responsibility of the consumer and the service provider.
For referrals that result in completed and paid business, NIA facilitates referral rewards via Stripe. Referral senders will receive the share of the commission stated in the App at the time the referral is accepted (currently 64%). Business providers set their commission rates and may change them at their discretion.
User Conduct & Eligibility
- Users must be at least 18 years old and reside in the United States.
- You agree not to use the App for unlawful purposes.
- You agree not to submit false referrals or fraudulent claims.
Reviews and Feedback
You may submit reviews for service providers after a job is completed. NIA reserves the right to moderate, edit, or remove reviews that violate its content policies or applicable laws. NIA is not liable for user-generated content.
No Guarantees or Warranties
NIA makes no warranties or representations regarding the quality, availability, or reliability of any service provider. All interactions and agreements between users and service providers are strictly between those parties.
Limitation of Liability
To the fullest extent permitted by law, NIA disclaims all liability for any damages, losses, or claims arising out of or related to your use of the App or your interactions with service providers.
Indemnification
You agree to indemnify, defend, and hold harmless NIA, its affiliates, and employees from any claims, damages, or expenses arising out of your use of the App or any services obtained through it.
Dispute Resolution
All disputes arising out of or relating to these Terms or your use of the App shall be resolved through binding arbitration in Harris County, Texas, in accordance with the rules of the American Arbitration Association. You waive your right to participate in any class action or class-wide arbitration.
Governing Law
These Terms shall be governed by and construed under the laws of the State of Texas, without regard to its conflict of laws principles.
Modifications
NIA reserves the right to modify these Terms at any time. Continued use of the App after any changes constitutes your acceptance of the revised Terms.
